Minnesota has not opted out of the federal exemptions.
“Except as provided in this section, the exemptions set forth in
subsection (d) of section 522 of the Bankruptcy Act, United
States Code, title 11, section 522(d), shall be available to
residents of this state.” Minn. Stat. § 550.371(1). So, if it is the
applicable state (as determined by the method stated on the
home page of this site), the federal exemptions may be used
regardless of whether the debtor is or is not a resident of this
state on the date of filing bankruptcy.
