Delaware's opt-out applies only to Delaware domiciliaries. “In
any bankruptcy proceeding, an individual debtor domiciled in
Delaware is not authorized or entitled to elect the federal
exemptions as set forth in § 522(d) of the Bankruptcy Reform
Act of 1978 (11 U.S.C. § 522(d)).” Del. Code Ann. Tit. § 4914
(a). So, if this state is the applicable state (as determined by
the method stated on the home page of this site), debtors who
are not Delaware domiciliaries on the date of filing bankruptcy
may use the federal exemptions.
