“Residents of this state are entitled to the exemptions provided
by this act. Nonresidents are entitled to the exemptions
provided by the law of the jurisdiction of their residence. (2)
The term ‘resident’ means an individual who intends to
maintain his home in this state.” Idaho Code Ann. § 11-602.
This state permits only its residents to use its exemptions.
Therefore, if it is the applicable state (as determined by the
method stated on the home page of this site), its exemptions
may be used only if the debtor is a resident of this state on the
date of filing bankruptcy.
