North Carolina has opted out of the federal exemptions, but
the opt-out applies only to residents. “The exemptions
provided in The Bankruptcy Code, 11 U.S.C. § 522(d), are not
applicable to residents of this State.” N.C. Gen. Stat. § 1C-1601
(f).
Therefore, if this state is the applicable state (as determined
by the method stated on the home page of this site), debtors
who are not residents of North Carolina on the date of filing
bankruptcy may use the federal exemptions.
