Texas’ homestead exemption is not extraterritorial. “The
definition of a homestead as provided in this section applies to
all homesteads in this state whenever created.” Tex. Prop.
Code Ann. § 41.002(d). In re Peters, 91 B.R. 401 (Bankr.W.D.
Tx.1988) (exemptions laws are local and have no extra-
territorial force). In In re Tate, 2007 WL 81835 (Bkrtcy.D.Or.
2007), the Court allowed debtor, under the saving provision,
to use the Oregon homestead exemption because the Texas
homestead exemption was not applicable outside Texas.
However, all the federal exemptions were available to the
debtor without resort to that provision and there is dispute as
to whether "any" in the saving provision means "any one" (as
this Court apparently interpreted it) or "all." For more, click
